PROPOSAL FOR COMPLETION OF CALLE FELIBERTO
Due to a change in the subdivision regulations, adopted after construction on Calle Feliberto began, requiring fire protection and the upgrade of Calle Feliberto from a Type D to a Type C roadway, requiring 6” of base course instead of the previously required 2” and from rapidly rising fuel and other costs, an increase of Two Hundred Fifty Thousand Dollars ($250,000.00) has been added to the funds needed for the Calle Feliberto Road Association to fully comply with the Taos County Subdivision Regulations.
This increase of cost, along with a slow real estate market, and a sluggish economy, has helped to create a hardship for the Calle Feliberto Road Association in so far as the members of the association have little or no way to continue to fund the association, through the sale of individual lots without the approval of pending and soon-to-be pending Summary and Type III subdivisions.
The Calle Feliberto Road Association has already collected and spent over Six Hundred and Thirty Thousand Dollars ($630,000.00) on the improvement of Calle Feliberto, including utilities, and is dedicated to its completion. In order to continue towards the completion of Calle Feliberto, a number of individual developers along the road, acting separately from the Calle Feliberto Road Association, yet acting together, would like to propose the following measures in order to allow for the completion of Calle Feliberto and for the compliance of the county regulations while at the same time allowing pending and soon-to-be pending Summary and Type III subdivisions submitted by the participating developers to be deemed complete:
- Six inches of base course shall be placed, in accordance with Taos County Regulations, along the whole of Calle Feliberto within three years of County approval of proposal, extended for an additional two years, if the escrow has not collected at least 85% of the amount needed for completion of the base course. As money is collected into the escrow account, it will be used periodically to complete the construction of the base cousre.
- Bonds for the completion of the base course will be acquired; such bonds will be reduced in the future by the amount accumulated in an escrow account for the completion of the base course. The escrow account shall be funded, as follows: For each lot, there will be determined an assessment based upon the total financial commitment to the construction of Calle Feliberto and the number of such owner's divisible lots. The construction estimate will be reviewed on an annual basis by Alex Abeyta or an actual cost estimate provided by a qualified contractor. Each owner shall be required to deposit at closing of the sale of each lot into the escrow account an amount equal to a 2X or greater the assessment per lot up to the amount due for that subdivision less prior assessments paid.
- Two 30,000 gallon water storage tanks shall be placed, in accordance with Taos County Regulations, at approximately the one mile and three mile mark along Calle Feliberto, as well as a guardrail along the S-curve approximately 1.1 miles in from HWY 64 and speed limit signs. Within ten days of County approval of this proposal orders with down payment shall be placed with installation as soon as possible after receipt of above equipment.
We would ask that:
- The Taos County Planning Department review and deem applications for Summary and Type III Subdivisions on Calle Feliberto, whose only requirement remaining is the completion of Calle Feliberto, complete and ready for final plat approval with the condition that the above be completed within the time allowed.
- We would also ask that Taos County Planning Department enforce regulations [Taos County Regulation Subdivision Ordinance 2005-8: 4.3.9 (C 1(b) and require/confirm subdividers to become members in good standing of the CFRA.
